El Paso Opposes Permit Extension

February 21, 2007 -- In a letter dated December 22, 2005, signed by Erich M. Birch, the City Attorney’s Office responded to the Executive Director’s request for an extension to May 1, 2007 of ASARCO’s air permit application (Air Quality Permit No. 20345), by requesting that the Texas Commission on Environmental Quality (TCEQ) deny the request for the following reasons:

• ASARCO failed to take the necessary steps to ensure a timely and adequate review of its existing emission control equipment and practices; and

• Neither the Texas Water Code nor the Commission has the necessary authority to extend an established order.
